Terms of Service

1. Acceptance of Terms

By accessing or using Scrollage ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all users, including visitors, registered users, and subscribers.

2. Description of Service

Scrollage is a visual microsite platform that allows users to:

• Create swipeable visual pages (called "scrolls") with photos, videos, and text
• Organize content into categories for portfolios, services, products, or menus
• Share content via custom subdomains (username.scrollage.co) and QR codes
• Add external links and action buttons (Call, WhatsApp, Email, Social Media, Custom URLs)
• Track page views and engagement analytics
• Customize branding and color themes (Pro plan)

3. User Accounts

3.1 Registration

To use Scrollage, you must create an account by providing a valid email address and creating a password. You must be at least 16 years old to use the Service.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3.3 Username Policy

Your username becomes your subdomain (username.scrollage.co). Usernames must not:

• Infringe on trademarks or intellectual property rights of others
• Impersonate another person or entity
• Contain offensive, vulgar, or inappropriate language
• Be misleading or confusing to other users

We reserve the right to reclaim or reassign usernames that violate these policies.

4. Subscription Plans and Billing

4.1 Free Plan

The Free plan includes:

• 1 scroll (category)
• Maximum 5 content items
• QR code generation
• External links and action buttons
• Contact and share buttons
• Scrollage branding visible on your page
• Default color theme only

4.2 Pro Plan

The Pro plan is available at $9/month or $90/year and includes:

• Unlimited scrolls
• Unlimited content items
• Remove Scrollage branding
• Custom color themes
• All QR code features
• All external links and action buttons
• Priority customer support

4.3 Billing

Pro subscriptions are billed in advance on a monthly or annual basis. You authorize us to charge your payment method on a recurring basis. Payments are processed through Paystack, our payment processor. We do not store your credit card information.

4.4 Cancellation

You may cancel your Pro subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial months or years, except as specified in our Refund Policy.

4.5 Price Changes

We reserve the right to change our subscription prices. We will provide at least 30 days' notice of any price changes. Continued use of the Service after a price change constitutes acceptance of the new price.

5. Content and Conduct

5.1 Your Content

You retain ownership of all content you upload to Scrollage. By uploading content, you grant Scrollage a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute your content as necessary to provide the Service.

5.2 Content Restrictions

You agree not to upload, post, or transmit any content that:

• Infringes on intellectual property rights of others
• Contains illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or hateful content
• Contains nudity, sexually explicit material, or pornography
• Promotes violence, illegal activities, or discrimination
• Contains malware, viruses, or harmful code
• Violates any local, state, national, or international law
• Impersonates another person or misrepresents your affiliation with any entity

5.3 Content Moderation

We reserve the right to review, remove, or refuse to display any content that violates these Terms. We may suspend or terminate accounts that repeatedly violate our content policies.

5.4 Storage Limits

Content uploads are subject to the following limits:

• Images: Maximum 50MB per file
• Videos: Maximum 500MB per file, 10 minutes duration
• Total storage: Reasonable use policy applies; we may contact you if your usage is excessive

6. Intellectual Property

6.1 Scrollage Intellectual Property

The Scrollage platform, including its design, features, graphics, logos, and software, is owned by Scrollage and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.

6.2 Trademarks

"Scrollage" and the Scrollage logo are trademarks of Scrollage. You may not use our trademarks without our prior written consent.

7. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policyexplains how we collect, use, and protect your personal information. By using Scrollage, you consent to our data practices as described in the Privacy Policy.

8. Prohibited Uses

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to our systems or other user accounts
• Interfere with or disrupt the Service or servers
• Use automated systems (bots, scrapers) to access the Service without permission
• Reverse engineer, decompile, or disassemble any part of the Service
• Remove or alter any copyright, trademark, or proprietary notices
• Use the Service to send spam, phishing attempts, or malicious content
• Resell or commercially exploit the Service without authorization

9. Third-Party Links and Services

Scrollage allows you to add external links to third-party websites and services (e.g., social media, booking platforms, e-commerce sites). We are not responsible for the content, privacy practices, or terms of these third-party services. Your interactions with third-party services are governed by their own terms and policies.

10. Disclaimers and Limitation of Liability

10.1 Service Availability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free. We may suspend or discontinue the Service at any time without notice.

10.2 Limitation of Liability

To the maximum extent permitted by law, Scrollage shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability for any claims shall not exceed the amount you paid to Scrollage in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Scrollage, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your content or any content you upload
• Your violation of any rights of another party

12. Termination

12.1 Termination by You

You may terminate your account at any time by contacting us at hello@scrollage.co. Upon termination, your account and content will be permanently deleted.

12.2 Termination by Scrollage

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion. We will make reasonable efforts to notify you before termination, except in cases of severe violations.

12.3 Effect of Termination

Upon termination, your right to access and use the Service immediately ceases. Sections of these Terms that by their nature should survive termination (including payment obligations, intellectual property provisions, disclaimers, and limitations of liability) will continue to apply.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through a notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after changes are made constitutes acceptance of the revised Terms.

14. Governing Law and Dispute Resolution

14.1 Governing Law

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

15.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms to any affiliate or successor in the event of a merger, acquisition, or sale of assets.
